Declaration of Resistance




The following actions of the federal gov’t are but a few  examples of the  government  (1) promulgating  laws and federal mandates not within the purview of their enumerated powers and (2) willfully not enforcing the nations’ laws and (3) recklessly disregarding their duties.   All three (1)(2) and (3) represent abuse of governmental power  and a breach of fidelity to serve faithfully …. threatening the freedoms and liberties guaranteed to the people by the U.S.Constitution.  This is not by any measure an exhaustive list of grievances.


(1)  Usurpations of Powers  / Abuse of Power

  • Implementation of laws governing a person’s healthcare without Constitutional authority.
  • Enacting the “Dream Act” by Executive Order which provides a form of amnesty for the children of illegals using   “prosecutorial discretion” .
  • Using NSA national defense strategies to target US citizens for potential assassination “without due process.”         
  • Nationalization of General Motors to bail it out... illegally ousting the CEO and forcing investors to accept millions in losses while protecting union interests.
  • Implementing Executive Order 13575 which establishes unchecked federal control into rural America in education, food supply, land use, water use, recreation, property, energy, and the lives of 16% of the US population. No Congressional or local government oversight or input. *
  • Misuse of federal power and money in illegal international gun and drug running, the misdistribution of taxpayer funds and manipulation of foreign governments, racketeering and smuggling, such as Project Gun Runner, resulting in the murder of U.S. agents.
  • Abusing the power of the IRS to target political opposition groups
  • Abusing the power of the National Security Agency to spy on Americans.
  • Making unauthorized (Presidential) recess appointments to both the NLRB and the CFPB without Senate approval.




(2)  Non-enforcement and Selective Application of Law

  • Department of Justice refusing to prosecute Black Panthers in Philadelphia caught on tape brandishing weapons in front of a voting site to intimidate voters.
  • Justice Department refusing to sue sanctuary cities for violating US immigration law.
  • Justice Department’s refusal to support, defend and enforce the Defense of Marriage Act, stating it was unconstitutional, thereby circumventing established law and the rulings of the courts.
  • Executive Branch refusal to enforce immigration law in direct violation of Article IV, Section 4 of the Constitution. 
  • Applying ‘prosecutorial discretion’ to not enforce mandatory minimums of drug abuse convictions.
  • Subversion of the (Patient Protection and Affordable Care Act) law  by suspending, delaying and waiving portions of the law for certain groups and organizations to include Congress who don’t have to participate in Obamacare.
  • Presidential edict changed work requirements for welfare recipients in 2012, by-passing Congress and making it far easier not to do anything in exchange for benefits. 


(3)  Dereliction of Duties

  • Failure to provide the necessary security to our mission in Benghazi Libya resulting in the ‘preventable’ deaths of four (4) Americans.  Further, engaging in shameful deception to conceal facts surrounding the attack.
  • As Commander-in- Chief of our Armed Forces, forcing our combat troops to abide by politically motivated Rules of Engagement (ROE) on the battlefield that endangers their lives and gives the enemy a tactical advantage.
  • Reckless deficit spending of taxpayer money each fiscal year that weakens our economy and our political influence.
  • Failure to reign in the national debt which exceeds  $17 trillion dollars.
  • Failure to pass a balanced budget.
  • Failure to support a national energy policy toward energy independence, deferring to a politically-motivated voting constituency that worships the planet and not the people.
  • Provocative discourse on monetary policy and social issues that divides the nation along racial and economic lines.
  • Allowing federal budget mandated programs (Medicare, Medicaid, Social Security) to consume 50% of the federal budget without a plan to contain growth.
